Summons (Unlawful Detainer)

This form is used to officially notify a tenant that a landlord is taking them to court to force them to leave the rental property, typically because they haven't paid rent, violated the lease, or the tenancy has ended. A landlord would use this form when they want to evict a tenant and need to legally serve them with court papers.

Complaint — Unlawful Detainer

The UD-100 form is used by a landlord to start a court case to evict a tenant from a rental property. A landlord would need this form when a tenant stops paying rent, violates the lease agreement, or refuses to leave after their tenancy ends.

Attachment — Unlawful Detainer

This form is used by a landlord to ask a court to remove a tenant from a rental property and get back any unpaid rent or damages. A landlord would need this form when a tenant refuses to leave after being asked or stops paying rent.

Declaration (Unlawful Detainer)

This form allows a landlord or property owner to submit written factual statements under oath to support their unlawful detainer case, which is a court action to evict a tenant. The declaration presents evidence about why the tenant should be removed from the property.

Answer — Unlawful Detainer

This form is used by a tenant to respond to a landlord's eviction lawsuit and tell the court their side of the story. A tenant who has been served with an eviction notice needs to file this form if they want to fight the eviction in court instead of moving out.

Form Interrogatories—Unlawful Detainer

This form allows a landlord to ask a tenant written questions that must be answered under oath during an eviction case. Landlords use it to gather information about the tenant's finances, occupancy, and defenses to the unlawful detainer eviction lawsuit.

Judgment — Unlawful Detainer

This form is used by a landlord who has won an eviction case in court to document the judge's decision ordering a tenant to leave the rental property. A landlord would use this form after successfully proving in court that a tenant violated their lease or failed to pay rent.

Request for Entry of Default (Unlawful Detainer)

This form allows both the landlord and tenant in an eviction case to agree on the terms of a judgment without going to trial. Landlords and tenants use this stipulation form to quickly resolve eviction disputes by settling on rent owed, move-out dates, or other agreed-upon terms.

Declaration for Default Judgment by Court (Unlawful Detainer—Civ. Proc., § 585(d))

This form allows a court to issue a default judgment for eviction without requiring the landlord to appear in court or present evidence. Landlords use this form when a tenant fails to respond to an eviction lawsuit, enabling the court to quickly process the eviction judgment.

Verification by Landlord Regarding Rental Assistance—Unlawful Detainer

This form allows landlords to verify that they have received rental assistance payments for a tenant's unpaid rent in an unlawful detainer (eviction) case. Landlords use it to demonstrate to the court that the tenant's debt has been paid through a government rental assistance program, which can stop or resolve an eviction proceeding.

Request to Dismiss Unlawful Detainer Case

This form is used to formally dismiss or withdraw an eviction lawsuit before it goes to trial or judgment. Either the landlord or tenant can file this to end the case.
